Lukash, Advisor of the President, President’s Representative at the Constitutional Court of Ukraine, and informed her about challenges that asylum seekers and refugees are facing in Ukraine and UNHCR’s role in identifying durable solutions to their problems.

UNHCR discussed with the Presidential Administration legislative developments in the field of refugee protection and how best to ensure compliance with the “National Plan of Actions on Liberalization of the Visa Regime for Ukraine and the 1951 Convention Relating to Refugees.

On behalf of the Presidential Administration, Ms. Lukash was supportive of UNHCR efforts to improve Ukrainian legislation, notably the existing Refugee Law and the draft Law of Harmonizing Certain Legislative Acts of Ukraine with the 2011 Refugee Law, and achieve compliance with obligations undertaken with “National Plan of Actions on Liberalization of the Visa Regime for Ukraine” and the 1951 Convention.

Ms. Lukash was also informed about UNHCR’s view on the advisability to ratify the 2002 Chisinau Convention on legal aid and legal relations on civil, family and criminal cases (which has the safeguards on asylum seekers and refugees non-refoulement through extradition).

It was agreed that cooperation would also extend to reviewing relevant Cabinet of Ministers Resolutions which currently limit access of asylum-seekers to medical assistance and permit that foreigners and stateless persons can be detained up to 12 months without a court sanction.

UNHCR welcomed the Resolutions of the Cabinet of Ministers on travel documents for Refugees and Beneficiaries of Complementary Protection compatible with the UNHCR recommendations and the international standards.

The exchange of views also touched on a number of other issues and UNHCR was encouraged to continue to inform the Presidential Administration on matters of concern.
